TD Thanks You

The Contest is in no way sponsored, endorsed or administered by, or associated with Rogers Blue Jays Baseball Partnership (“RBJBP”), owner of the Toronto Blue Jays™ Major League Baseball Team (the “Team”) or the MLB Entities (as defined below). RBJBP, the MLB Entities, their affiliates, and each of their respective officers, directors, shareholders, agents, representatives and employees will have no liability or responsibility for any claim arising in connection with participation in this contest or any prize awarded.

The “MLB Entities” shall mean the Office of the Commissioner of Baseball (the “BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (the “Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

1. CONTEST PERIOD: The TD Thanks You Spring Training Experience Contest (the “Contest”) begins at 12:01 AM Eastern Time ("ET") on August 8th, 2024 and ends at 11:59 PM ET on September 21st, 2024 (the “Contest Period”). The Sponsor of the Contest is The Toronto-Dominion Bank, 9th floor, TD Tower North, 77 King Street West, Toronto, ON M5K 1A2 (“TD"). The contest administrator for this Contest is Diamond Integrated Marketing, 477 Richmond Street. W. #1000, Toronto, ON M5V 3E7 (the "Contest Administrator").

2. ELIGIBILITY: The Contest is open to all residents of Canada: a) who are existing TD customers of any one or more of TD Retail Personal Banking, TD Retail Small Business Banking, TD Wealth, and/or TD Insurance (each a "TD Group" and collectively "TD Groups") on or before July 31st, 2024; b) whose TD Group(s) account(s) are active and in good standing; and c) who are the legal age of majority in their Province/Territory of residence at the time of entry into the Contest, (each an "Eligible Participant"). The following individuals and their household members are not eligible to enter the Contest: Employees, agents, and representatives of each of (i) TD, (ii) its subsidiaries and affiliates, and (iii) any and all other companies associated with the Contest including the Contest Administrator, and their respective subsidiaries and affiliates.

3. HOW TO PARTICIPATE: No purchase necessary. "Entrant" means the Eligible Participant who, during the Contest Period, fully completes and submits a Contest entry form (the "Form") with their full name, phone number, the email address associated with their TD Group account profile as an existing TD customer, and their preferred time of day for phone contact (i.e. morning, afternoon or evening) (each an "Entry" and collectively the "Entries"). The Form is available at www.tdthanksyou.com. Limit one (1) Entry per Entrant.

4. PRIZE: There is one (1) prize available to be won of a Spring Training Experience package, as described below (the “Prize") with a total approximate retail value (ARV) of CAD$5,370

• Two (2) tickets for the winner and their traveling companion guest (collectively, the "Prize Participants") to an afternoon Toronto Blue JaysTM spring training game in March 2025 (exact date, time, and seats to be determined and confirmed by TD and/or the Contest Administrator) (the “Event”) located at TD Ballpark, 373 Douglas Ave, Dunedin, Florida (the “Venue”) (ARV CAD$100)
• Two (2) Toronto Blue Jays replica Jerseys with choice of sizing (max total ARV CAD$400)
• Two (2) airfare travel vouchers of CAD$1,500 each (airline to be determined by TD in its sole discretion) (each an "Airfare Voucher" and collectively "Airfare Vouchers"). (total ARV of CAD$3,000)
• 4-star hotel accommodations (double room occupancy) (the "Hotel") for one (1) night in Dunedin, Florida (ARV CAD$500). Exact hotel to be determined in the sole discretion of TD and the Contest Administrator
• Two (2) pre-paid Visa* gift cards of USD$500 each (total ARV USD$1,000 equivalent to approx. CAD$1,370 as of July 18, 2024)
   

Note: The total ARV of the Prize is inclusive of the Airfare Vouchers and is based on the departure city of Whitehorse, Yukon. Therefore, the total ARV of the Prize may vary depending on the winner's actual departure city

Prize Conditions
 
a) The Prize must be accepted as awarded and no substitution, transfer, conversion to cash or otherwise, or assignment of the Prize will be allowed, unless at the sole discretion of TD, which may substitute another prize of lesser, equal or greater value.

b) The winner will be responsible for booking and managing their own flight and that of their travelling companion guest, which they can do through the airline, using the Airfare Vouchers included in the Prize. The Airfare Vouchers can be applied towards any products and services offered by or through the airline and are subject to the airline terms and conditions including any terms and conditions that may be printed on the Airfare Vouchers. Any air travel expenses not covered by the Airfare Vouchers, if used, will be the sole responsibility of the winner.

c) The Prize Participants are responsible for ensuring they have all necessary travel documents (e.g., valid government issued identification) and for complying with any and all health and safety protocols. TD is not responsible in the event any Prize Participant is refused boarding at any time by any airline or airport security.

d) The winner will be responsible for all ground transportation for the Prize Participants to and from their home departure airport, to and from their destination arrival airports, to and from the Hotel, and to and from the Venue.

e) All Prize details not specifically addressed in these Contest rules will be determined in the sole discretion of TD. Winner must be available to travel at the time the Event is scheduled to be held or will forfeit the Prize.

f) Any unused portion of the Prize, but not including the Airfare Vouchers or the pre-paid Visa gift cards, will be forfeited.

g) Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see bluejays.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. The Prive Participant’s must be of legal age of majority in his/her(their) jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. RBJBP and the MLB Entities reserve the right to remove or to deny entry to any Prize Participant who engages in a nonsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. RBJBP and the MLB Entities will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to winner’s (and guest’s) consent to and compliance with all health and safety policies of the MLB Entities, including but not limited to the wearing of masks if and when directed and the requirement to be fully vaccinated against COVID-19 (i.e., having received a final vaccination dose at least 14 days prior to the event), as applicable.

h) The winner is solely responsible for acceptance and use of the Prize and for any costs, fees, taxes and expenses associated with the Prize, including any federal and provincial taxes applicable to the Prize, that are not specified herein as being provided, including but not limited to travel and health insurance, transportation costs (including checked baggage fees, excess baggage fees), meals and gratuities, and any other expenses incurred by the Prize Participants in claiming, accepting and/or using the Prize.

5. DRAW DATES: One (1) random draw (the “Draw”) for the Prize will be held in Toronto, ON at 9:30 AM ET on September 22nd, 2024. The odds of winning will depend on the total number of eligible Entries received.

6. ENTRANT SELECTION: If you are a selected Entrant in the Draw, you will be provided specific instructions on what you are required to do in order to claim your Prize. The Prize will be awarded only upon verification and final approval by TD. No communication will be entered into with any Entrants except with the selected Entrant(s).

Attempts will be made to contact the selected Entrant, based on the contact information provided at the time of entry, for a period of three (3) business days following the Draw date. If the selected Entrant cannot be contacted within the allotted time, TD reserves the right to void that Entry and select another eligible Entrant for the Prize. In order to be declared an official winner, the selected Entrant must correctly answer a mathematical skill-testing question without mechanical or other assistance. The selected Entrant will be required to complete, sign and return a Declaration and Release Form within two (2) business days of receipt. If the selected Entrant fails to complete, sign and return the Declaration and Release Form within two (2) business days and/or provides an incorrect answer to the mathematical skill-testing question, TD and/or the Contest Administrator reserve the right to void that Entry and select another eligible Entrant for the Prize.

7. CONTEST GENERAL RULES: By entering the Contest, Entrants agree to abide by these Contest Rules and the decisions of TD and the Contest Administrator, which are final. All Entrants release and forever discharge each of the Contest Administrator and TD, their advertising and promotional agencies, RBJBP, the MLB Entities, the affiliated companies of each of the foregoing and all of their respective officers, directors, employees, and agents, as well as all other companies associated with the Contest(collectively, the "Released Parties") from all claims, demands, damages, actions and causes of action arising or that could arise by reason of his/her/their participation in the Contest and/or the administration of the Contest, including, without limitation, the selection and awarding of the Prize. By entering the Contest, Entrants give permission to TD, at its option, to publish or otherwise use the Entrant's name, address, photograph, voice and comments, without compensation, in any publicity carried out by TD or its advertising agencies where such Entrant is declared to be the winner of a Prize. TD reserves the right, in its sole discretion to terminate the Contest, in whole or in part, or modify, amend or suspend the Contest and/or the Contest Rules in any way at any time for any reason, without prior notice or compensation. TD,the Contest Administrator, RBJBP and the MLB Entities shall in no way bear any liability whatsoever regarding the Prize. In no event shall TD, the Contest Administrator, RBJBP or the MLB Entities be liable for any special, incidental, consequential, indirect or punitive damages arising out of or in connection with this Contest and/or the Prize or its uses, however arising, including negligence.

8. DISQUALIFICATION: TD and the Contest Administrator are not responsible for lost Entries, interrupted or unavailable network servers or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled, or misdirected transmissions, or other errors of any kind whether human, mechanical or electronic. Any Entrant found tampering with, undermining, or abusing any aspect of this Contest, as determined by TD and/or the Contest Administrator, will be disqualified. In the event any portion of this Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of TD and/or the Contest Administrator, which, in the sole opinion of TD and/or the Contest Administrator, corrupts, or impairs the administration, security, fairness or proper entry into the Contest, TD and the Contest Administrator reserve the right, in their sole discretion, to suspend or terminate this Contest, or to amend the Rules of the Contest.

9. APPLICABLE LAWS: This Contest is subject to all applicable federal, provincial and municipal laws. Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between an Entrant and TD in connection with the Contest shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, including procedural provisions, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. Any litigation must be commenced in the City of Toronto, ON.

10. PRIVACY: By entering this Contest, Entrants consent to the collection, use and sharing of information about them by TD with third parties, including the Contest Administrator, for the purpose of administering this Contest, in accordance with the TD Privacy Code at www.td.com/privacy.
